Agreement to Terms
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Video Catalyst ("we," "us" or "our"), concerning your access to and use of the videocatalyst.xyz website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto.
Intellectual Property Rights
The Service and its original content, features and functionality are and will remain the exclusive property of Video Catalyst and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
User Representations
By using the Service, you represent and warrant that:
- All registration information you submit will be true, accurate, current, and complete
- You will maintain the accuracy of such information and promptly update such registration information as necessary
- You have the legal capacity and you agree to comply with these Terms of Service
- You are not under the age of 13
- Not a minor in the jurisdiction in which you reside, or if a minor, you have received parental permission to use the Service
- You will not access the Service through automated or non-human means
- You will not use the Service for any illegal or unauthorized purpose
- Your use of the Service will not violate any applicable law or regulation
Prohibited Activities
You may not access or use the Service for any purpose other than that for which we make the Service available. The Service may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.
Services
Video Catalyst provides professional video production services including but not limited to corporate videos, marketing content, event documentation, product demonstrations, and brand storytelling. All services are subject to availability and our professional standards.
Payment Terms
Payment terms will be specified in individual service agreements. Generally, a deposit is required to begin work, with the balance due upon completion. All payments are non-refundable unless otherwise specified in writing.
Limitation of Liability
In no event will Video Catalyst, its affiliates, agents, directors, employees, suppliers or licensors be liable to any person for any indirect, incidental, special, punitive, cover or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use of content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity) however caused, under any theory of liability.
Governing Law
These Terms of Service and your use of the Service are governed by and construed in accordance with the laws of the State of Illinois without regard to its conflict of law principles.
